Important – New Timelines For Notice Periods

The Residential Tenancies Amendment legislation was signed into law by the President. Parts of it are scheduled to be commenced on the 4th June 2019. From the 4th June notices of termination served will have to abide by the new timelines, and notices may require technical amendment.

Notices served before the 4th June will not require the new timeline and the existing templates may be used. If IPOA members are intending to serve a notice of termination after June 4th, please refer to the new templates.  Available Now.

Notice Periods Required by Landlords

Duration of Tenancy Notice Period – Residential Tenancies Act 2004 (as amended in 2015) Existing Notice periods expected to commence 4th June 2019

Less than 6 months                                       –      28 days
6 or more months but less than 1 year      –      90 days
1 year or more but less than 2 years          –       120 days
2 years or more but less than 3 years        –       120 days
3 years or more but less than 4 years        –       180 days
4 years or more but less than 5 years        –       180 days
5 years or more but less than 6 years        –       180 days
6 years or more but less than 7 years        –       180 days
7 years or more but less than 8 years        –       196 days
8 or more years                                              –       224 days


Rent Pressure Zone Changes

Dublin, Wicklow, Meath and Kildare will be removed from the averaging formula, which is used to calculate average rent. Average rent will therefore be much lower and a number of areas that are not in Rent Pressure Zones will become Rent Pressure Zones, limiting the rental increases to either 2% or 4% per annum. If the rent is very low, and an area is designated a Rent Pressure Zone you must comply with the legislation.

A rent increase notice must be in the prescribed format, and give over 90 days-notice. There must be an entitlement to serve the notice. A valid rent increase notice served prior to the designation of an area as a Rent Pressure Zone, would be upheld even in a situation where an area was subsequently designated a Rent Pressure Zone before the effective date of the increase.
