Do I Have To Re-Register To Start A Case With The RTB?

9th November, 2020

Question:

I served a notice of termination before the end of a part 4 tenancy. The part 4 would have been due for renewal with RTB a month after I served notice but as I terminated the tenancy I did not renew. The notice period is over and the tenant is overholding. It looks like I will have to take a dispute resolution case to the RTB. Will I have to register again to be able to commence the case?

Response:
Assuming a valid registration was in place prior to the ending of the tenancy and that the notice of termination is valid, you would be taking the case for holding on this registration. You do not need to re-register as there is no tenancy to register. You do not need to re-register to commence a case.
