The Residential Tenancies (Amendment) (No. 2) Act 2021 commenced on the 11th December 2021.
- From 11th December 2021 restricts rent increases in Rent Pressure Zones from exceeding general inflation and will be subject to a cap of 2% per year on a pro rata basis, where HICP inflation is higher.
- provide for tenancies of unlimited duration providing security of tenure for tenants. This applies to all new tenancies created on or after 11th June 2022.
Existing six year tenancies if not terminated prior to the end of the part 4 tenancy, will become tenancies of indefinite duration.
Tenancies can still be terminated under section 34 of the Residential Tenancies Act 2004 as amended including for selling, own use, breach etc.
