Would it be discriminatory for a property owner to ask a prospective tenant if they had a criminal record?

July 2018

IPOA held a Seminar recently in the Ashling Hotel on Vetting and Selecting Tenants Equally and Fairly.   A question was raised and clarification was sought in respect of the question.  The query raised:-

Would it be discriminatory for a property owner to ask a prospective tenant if they had a criminal record?   The question was emailed to the Irish Human Rights and Equality Commission and they outlined the specific grounds covered by the Act.

Asking a prospective tenant if they have a criminal record is not contained in the grounds that are classed as discriminatory.
